Terms of sale
The sale of the goods is made by the auction-house Tschoepe as an agent
acting in the name of, and for account of, the seller.
All auctions are conducted in EURO currency and immediate payment is expected.
All bids are made in increments of 5% to 10%.
The starting bid will be the price quoted in the auction catalog. A valid
bid remains a legal and binding contract until the bid amount has been exceeded
or is refused by the auctioneer.
A bid is successful after a third call and when the hammer has fallen.
A draw will decide in case of a tie between two bidders. The award is binding.
If an agreement cannot be reached the lot will be auctioned off again. Agents
bidding on behalf of others will be held liable if their principals fail to
make payment.
The auctioneer reserves the right to change the order in which the lots
are presented, to separate, combine, withdraw any lot prior to sale , to award
with reservation or to refuse a bid below the reserve price.
The 20,88 % buyers charge consisting of 18% commission and 16% VAT on this
commission will be added to hammer price of each lot purchased.
Shippment expenses per parcel are 8 EUR (in Germany) 16 EUR for all other
countries.
Responsibility for the goods goes to the purchaser after the hammer has
fallen, title will pass after payment in full is received. Payments can be
made in cash, or bank transfer and are due 10 days after auctioneer has received
an invoice.
The buyer is liable for any currency or interest loss should he not follow
through with the sale or delay payment. The auctioneer then reserves the right
to file complaint, request compensation or cancel the sale. The buyer is liable
for all costs of a re-Auction of the lot but is not entitled to any additional
revenue.
The lots for auction can be viewed at specified times before the auction.
The catalogue descriptions are made to the best of the agents knowledge and
belief but are not 'assured qualities' under §§ 459ff BGB. The objects
for sale are used, in good condition, yet worn according to their age.
Justified claims must be submitted within 3 days after receipt of item
or within 2 weeks after the auction date. Multiple item lots are not subject
to any claims.
All items are shipped at purchaser's risk. Insurance is possible upon demand.
The agents responsibility ends with the mailing of the object. Shippment will
take place after payment.
Fax and phone orders must be confirmed in writing.
The placing of a bid shall constitute full acceptance of the foregoing
terms and conditions of sale.
Upon immediate written demand after an auction a small fee is charged for
additional information such as name and address of seller and purchaser.
All participants recognize the jurisdiction of the courts in Neuss, Germany.
Should any of these conditions be void the remaining policies will remain
in effect.
